Terms of Service

These Terms of Service ("Terms") govern your use of the Journal Jar mobile application ("App", "Service") operated by Yannick Remke Web Projects, Brüggemannhof 8, 30167 Hannover ("we", "us", "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Description of the Service

Journal Jar is a mobile application that helps you capture and preserve meaningful experiences. The App allows you to create journal entries for special moments, attach photos, rate their significance, track your mood, and organize your memories into collections. You can also maintain shared collections with friends or family and receive reminders about past moments, such as anniversaries.

2. Eligibility

You must be at least 16 years of age to use the App. By using the App, you represent that you meet this age requirement. If you are under the age of 18, you confirm that you have obtained consent from a parent or legal guardian.

3. Account Registration

To use the App, you must create an account using a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Free and Premium Plans

4.1 Free Plan

Journal Jar is free to download and use. The core features — creating entries, organizing collections, and sharing with others — are included at no cost. Free users may create up to three collections. Collections owned by another user and shared with you do not count towards this limit.

4.2 Premium Subscription

Journal Jar Premium is an optional paid subscription that unlocks additional features, including:

  • The ability to attach photos to journal entries
  • Unlimited collection creation

Premium subscriptions are billed on a recurring basis (monthly or annually) through Apple's App Store. Current pricing is available on the App Store listing. Payment is charged to your Apple ID account upon confirmation of purchase. Your subscription automatically renews unless you cancel it at least 24 hours before the end of the current billing period.

4.3 Shared Collection Premium Benefits

If any member of a shared collection holds an active Premium subscription, all other members of that collection may also attach photos to their entries within that collection, regardless of their own subscription status.

4.4 Cancellation

You may cancel your Premium subscription at any time through your Apple ID account settings. Upon cancellation, you will retain access to Premium features until the end of your current billing period. After that:

  • Previously uploaded photos will remain intact and visible.
  • You will not be able to add new photos to entries until you resubscribe.
  • If you exceed the three-collection limit, you will not be able to create new collections but your existing collections will remain accessible.

5. User Content

5.1 Ownership

You retain full ownership of all content you create or upload through the App, including text entries, photos, and other materials ("User Content").

5.2 License

By submitting User Content to the App, you grant us a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing the Service to you. We do not use your content for any other purpose.

5.3 Responsibility

You are solely responsible for the User Content you submit. You agree not to upload content that is illegal, harmful, abusive, defamatory, or that infringes on the rights of others.

6. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to gain unauthorized access to the App, its servers, or any related systems
  • Interfere with or disrupt the integrity or performance of the App
  • Reverse-engineer, decompile, or disassemble any part of the App
  • Use the App to distribute spam, malware, or other harmful content
  • Impersonate another person or entity
  • Use automated systems or bots to access the App

7. Availability

The App is currently available for iOS. An Android version is planned for a later release. We do not guarantee uninterrupted availability of the Service and may perform maintenance or updates that temporarily affect access.

8. Third-Party Services

The App relies on third-party services to provide its functionality, including but not limited to cloud hosting, authentication, payment processing, push notifications, crash reporting, usage analytics, and data synchronization. Your use of the App may also be subject to the terms and conditions of these third-party providers, including Apple's App Store Terms of Service for subscription purchases.

We select our third-party providers with care and require them to handle data in accordance with applicable data protection laws. However, we are not responsible for the availability, accuracy, or performance of these third-party services. We shall not be liable for any loss or damage arising from outages, errors, or changes to third-party services that are beyond our control.

Certain data may be shared with third-party providers as necessary to operate the Service. For details on which data is shared and for what purposes, please refer to our Privacy Policy.

9. Data Privacy and Security

Your privacy is important to us. Your data is stored exclusively on servers located in the European Union (Germany) and is subject to the General Data Protection Regulation (GDPR). Data transmission between the App and our servers is encrypted. We do not sell your data to third parties. 10. Account Deletion and Data Export

You may delete your account and all associated data at any time from within the App. All data will be irreversibly deleted after a safety period of a maximum of 30 days. You may also export and download your data at any time, regardless of your subscription status.

11. Intellectual Property

The App, including its design, code, branding, and all related materials (excluding User Content), is the intellectual property of Yannick Remke Web Projects and is protected by applicable copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.

12. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be error-free, secure, or continuously available.

13. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of goodwill, arising out of or in connection with your use of the App.

14. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the App, your User Content, or your violation of these Terms.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes through the App or via email. Your continued use of the App after such changes constitutes your acceptance of the updated Terms.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Hannover, Germany, unless mandatory consumer protection laws of your country of residence provide otherwise.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
